Background
These terms govern the commercial relationship between your organisation and Futa Financial Services (Pty) LTD ("Futa Finance", "we", "our", "us") when you access our software, APIs, or consulting services. By creating an account or signing a services order you confirm that you are acting on behalf of a licensed lender or financial institution and that you are authorised to enter into this agreement.
About Us
Futa Finance provides a cloud-based operating system for African microlenders. We deliver digital onboarding, alternative credit decisioning, portfolio monitoring, and servicing workflows from our headquarters in Windhoek, Namibia (Registration No. 2025/0643).
Our Relationship With You
We supply technology, data services, and operational support that help lenders digitize their origination and credit lifecycle. You remain solely responsible for regulatory compliance, final credit decisions, and communication with your customers. Any insights produced by the platform are for your internal use and should be validated against your own policies.
Scope and Changes
These terms apply to all environments, integrations, and pilot programs you access. We may update the terms from time to time to reflect new regulations or product enhancements. Material changes will be communicated in advance, and continued use of the platform after the effective date constitutes acceptance.
Registering an Organisation
To activate a workspace you must provide accurate company information, licensing evidence, and the contact details of nominated administrators. You agree to keep this information current and to restrict access to vetted personnel. We may refuse or suspend access if we cannot complete our due diligence.
Verification and Compliance
Under the Financial Intelligence Act (Act No. 13 of 2012) and related regulations, we must collect KYC/KYB information about our partner institutions and their authorised users. You consent to these checks and acknowledge that we can request additional documents at any time. Where we provide tools that help you verify your borrowers, you remain accountable for the accuracy of the information you capture.
Platform Access
We will issue administrator credentials that allow you to provision users within your organisation. You are responsible for managing roles, enforcing least-privilege access, and ensuring that your users comply with these terms. You must immediately notify us if you suspect unauthorised access or a security incident.
Suspension or Termination
We may suspend or limit your access if any of the following occur:
- You breach these terms or an applicable services order.
- We detect fraudulent, abusive, or illegal activity.
- A regulator or court requires us to restrict access.
You may terminate the agreement by giving written notice and settling any outstanding fees; upon termination we will disable access and provide data exports in accordance with our data retention schedule.
Data Protection
We process the personal data of your staff and applicants in order to deliver the platform, provide support, conduct analytics, and comply with the law. Our safeguards include:
- Administrative, technical, and organisational controls aligned to industry standards.
- Contractual requirements for all sub-processors to meet equivalent protections.
- Limited transfers outside Namibia, using contractual safeguards when needed.
Marketing and Communication
We may send service announcements, product updates, and thought-leadership content to your nominated contacts. You can opt out of non-operational communication at any time. With your consent, we may reference your organisation as a Futa Finance customer in marketing materials.
Declaration
By proceeding you confirm that all information supplied to Futa Finance is accurate, that you will use the platform solely for lawful lending activities, and that you will indemnify Futa Finance against losses arising from your breach of law or misrepresentation. The directors and employees of Futa Finance are not personally liable for claims linked to your use of the services.
